Introduction

Welcome to Fingerprint Marketing and Advertising, a service provided by DBH Communications, Inc. By accessing our website and using our services, you agree to comply with our Terms of Service outlined below.

Use of Service

Our services are designed for business clients to host their marketing websites on our VPS server. This agreement is limited to those hosting services and is not relevant to our marketing services, which requires a separate agreement. We emphasize security, reliability, and compliance with applicable laws and regulations.

User Obligations

Users are expected to use our services responsibly, adhering to all applicable laws and respecting intellectual property rights. Misuse of services for illegal activities is strictly prohibited.

Prohibited Uses

Websites will not be allowed that contain or provide any of the following:

• Unsolicited commercial email, or SPAM, is prohibited.
  
• User-Generated Content (UGC) including, but not limited to forums, social media sites, online communities, and blog comments.
  
  This exclusion specifically does not apply to securely managed user-generated content that is not publicly accessible, including but not limited to information collected through lead generation webforms and private communications facilitated by ticket support systems. Such content will be password-protected and stored securely on the server, ensuring that access is strictly limited to authorized users and support staff only.
  
• IP scanners, bruteforce programs/scripts/applications.
  
• Mail bombers/spam scripts.
  
• Anonymous or bulk SMS gateways.
  
• Websites or links to websites advocating human violence and hate crimes.
  
• Websites promoting illegal activities. or linking to other websites that promote illegal activities.
  
• Selling, or otherwise disseminating, pornography or other erotic material, regardless of its literary merit.
  
• Lottery/gambling or chain letters, regardless of content.
  
• Fraudulent sites.
  
• Broadcasting or streaming of live sporting events or television.
  
• Cryptocurrency/bitcoin miners.

If you believe that another client is using our network in violation of these policies, please contact us abuse@fingerprintmktg.com.

Content and Intellectual Property

As our client websites do not host user-generated content and are designed for professional use, we commit to protecting intellectual property rights and expect our clients to do the same.

If you believe that your copyrighted work has been used or displayed on our services in a way that constitutes copyright infringement, please provide us with a written notification containing the following information:

1. A signature, physical or electronic, of the copyright owner or a person authorized to act on their behalf.
   
2. Identification of the copyrighted work claimed to have been infringed.
   
3. Identification of the material that is claimed to be infringing, with enough detail so that we may locate it on our services.
   
4. Your contact information, including your address, telephone number, and email address.
   
5. A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
   
6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
   
7. For cases of trademark infringement, provide the registration details of the infringed trademark, including its registration number.

Please send your copyright infringement notification to our designated agent at abuse@fingerprintmktg.com.

Upon receipt of a valid DMCA notice, we will promptly remove or disable access to the infringing material and take reasonable steps to notify the user responsible for the alleged infringement. Repeat offenders will have their access to our services terminated.

Abuse Prevention and Handling

We have established procedures to handle abuse and ensure the security and integrity of our services. Reports of abuse can be directed to abuse@fingerprintmktg.com .

Privacy Policy

We are committed to protecting the privacy of our clients and their data. Our Privacy Policy outlines the measures we take to safeguard information.

Disclaimer and Liability

DBH Communications, Inc. disclaims all warranties to the extent permitted by law and limits liability for damages arising from the use of our services.

Termination of Service

We reserve the right to suspend or terminate services if these terms are violated.

Modifications

These terms may be updated at our discretion. Continued use of our services constitutes acceptance of the new terms.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Missouri. Exclusive jurisdiction and venue shall by in the Jackson County, Missouri superior courts.
